IN THE MATTER OF THE FILING OF CERTIFICATE OF CANDIDACY
FOR MEMBER OF THE HOUSE OF REPRESENTATIVES
OF THE TWO (2) LEGISLATIVE DISTRICTS OF
CAGAYAN DE ORO CITY FOR MAY 14, 2007
NATIONAL AND LOCAL ELECTIONS.

WHEREAS, Republic Act No. 9371, approved on February 22, 2007, apportioned Cagayan de Oro City, a Highly Urbanized City, into two (2) legislative districts to commence in the May 14, 2007 National and Local Elections, as follows:
“SEC. 1. - Legislative Districts - The lone district of the City of Cagayan de Oro is hereby apportioned to commence in the next national elections after the effectivity of this Act. Henceforth, barangays Bonbon, Bayabay, Kauswagan, Carmen, Patag, Bulua, Iponan, Baikingon,San Simon, Pagatpat,Canitoan, Balulang, Lumbia, Pagalungan, Tagpangi, Taglimao, Tuburan, Pigsag-an, Tumpagon, Bayanga, Mabuaya, Dansulihon, Tignapoloan and Bigisan shall comprise the first district while barangays Macabalan, Puntod, Consolacion, Camman-an, Nazareth, Macansandig, Indahag, Lapasan, Gusa, Cugman, FS Catanico, Tablon, Agusan, Puerto Bugo and Balubal and all urban barangays from Barangay 1 to Barangay 40 shall comprise the seconded district."
WHEREAS, there is no express requirement in RA No. 9371, that in the elections of May 14, 2007,the candidate running for Member of the House of Representatives in a certain legislative district in Cagayan de Oro City should be a registered voter of particular legislative district and a resident thereof for at least one year immediately preceding the day of the election;
WHEREAS, Article VI, Sec. 6 of the Constitution expressly provides that “no person shall be a Member of the House of Representatives unless he is a natural-born citizen of the Philippines and, on the day of the election, is at least twenty-five years of age, able to read and write, and, except the party-list representatives, a registered voter in the district in which he shall be elected, and a resident thereof for a period of not less than one year immediately preceding the day of the election.”
NOW, THEREFORE, the Commission RESOLVED, as it hereby RESOLVES, that for the May 14, 2007 National and Local Elections, and succeeding national elections, a candidate for Member of the House of Representative for any of the two legislative districts of Cagayan del Oro City must be a registered voter of the district in which he shall be elected, and a resident thereof for a period of not less than one year immediately preceding the day of the election.
Let the Education and Information Department, this Commission, cause the publication of this Resolution in two (2) daily newspapers of general circulation in the Philippines, and immediately furnish copies thereof to all Election Officer of Cagayan de Oro City and the Regional Election Director of Region X.
