PROPOSED MEDIA PLAN FOR OAV

      In connection with the Commission on Elections' continuing registration of voters program and pursuant to Republic Act 9189 - also known as the Overseas Absentee Voting Law, the Commission through the Committee on Overseas Absentee Voting (COAV) is set to resume the continuing overseas registration on 1 October 2005 until 31 August 2006 and the next National Elections on 14 May 2007.

      To ensure maximum participation in this crucial exercise, we are exploring the possibility of disseminating registration information to Filipino audiences abroad particularly in the United States, the Middle East, Europe and other parts of Asia through cable television, which is scheduled to commence on 1 May 2005.

      In compliance with the memorandum of Commissioner Florentino A. Tuason, Jr., Chairman, Committee on Overseas Absentee Voting dated 19 April 2005 and due to the urgency, aggravated by time constraints and in order to promote economy and efficiency, and as this involves procurement where only a few suppliers are known to be available, such that resorting to the public bidding method will not likely result in any additional suppliers participating in the bidding, the Bids and Awards Committee (BAC) resorted to limited source bidding (Rule XVI Section 49 of the Implementing Rules and Regulations (IRR) of R.A. 9184), which states, "Limited Source Bidding, otherwise known as selective bidding, is a method of procurement of goods and consulting services, that involves direct invitation to bid by the concerned procuring entity from a set of pre-selected suppliers or consultants with known experience and proven capability on the requirements of the particular contract. The pre-selected suppliers or consultants shall be those appearing in a list maintained by the relevant Government authority that has expertise in the type of procurement concerned, which list should have been submitted to, and maintained updated with, the GPPB. The BAC of the concerned procuring entity shall directly sent to the pre-selected bidders the invitation to bid, which shall already indicated the pertinent provisions of this IRR-A."

      Pursuant to the above-mentioned alternative method of procurement, we are formally inviting pre-selected broadcast television networks from the list provided and maintained updated by the National Telecommunications Company - Broadcast Division, to submit their proposed media plan, based on the following parameters:

Cost : The total cost should not exceed FIVE MILLION PESOS (PhP5,000,000.00)
Coverage : The media plan should reach audiences in Asia, the United States, the Middle East and Europe
Duration : The media plan should span the period from May to September 2005.

      In the proposal please indicate:
    • The number of subscribers in each of the key campaign areas;

    • The details of similar campaigns your company has successfully handled or mounted;

    • The cost of in-house production of one (1) 30-second TVC;

    • Any added value your may be able to provide.
      Please include in the submission the basic requirements for pre-qualification documents (see attached checklist) pursuant to Section 23 of IRR of R.A. 9184.

      The bidder shall post as part of their bid, Bid Security equal to any of the following forms: 1% Cash, certified check, cashier's check, manager's check, bank draft or irrevocable letter of credit; 1 ½ % bank guarantee; 2 ½% surety bond; and 100% Foreign Government Guarantee of the total Approved Budget for the Contract ("ABC") payable to COMELEC and valid for 120 days.

      The COMELEC reserves the right to reject any or all bids, waive any formality/defect contained therein, and accept the lowest calculated and responsive bid that is most advantageous to the Commission. Likewise, it reserves the right to review the qualifications of the bidders after the bidding and before the contract is executed. Should such review uncover any misrepresentation made in the eligibility statements, or any changes in the situation of the bidder to materially downgrade the substance of such statements, the COMELEC shall disqualify the bidder upon due notice without any obligation whatsoever for any expenses or losses that may be incurred by it in the preparation of its bid.
