Whereas, Section 10 of Republic Act No. 9369 provides: “To achieve the purpose of this Act, the Commission is authorized to procure, in accordance with existing laws, by purchase, lease, rent or other forms of acquisition, supplies, equipment, materials, software, facilities and other services, from local or foreign sources free from taxes and import duties, subject to accounting and auditing rules and regulations. x x x” 

         Now, therefore, the Special Bids and Awards Committee hereby resolves, as follows:

1. All bids, tenders, offers or quotations shall NOT include taxes and import duties.  As a result, there will be no retention of any corresponding amounts by the COMELEC.  The financial proposal templates are correspondingly amended.  (See attached)

2. The deadline for submission of sealed bids is moved to 4 May 2009 at 10:00 a.m. at the Convention Hall of the Bureau of the Treasury, 3rd Floor, Palacio del Gobernador, Intramuros, Manila in compliance with Section 22.5.2 of the Implementing Rules and Regulations of Republic Act No. 9184, as amended, which states:

“22.5.2. Supplemental/Bid Bulletins may be issued upon the procuring entity’s initiative for purposes of clarifying or modifying any provision of the bidding documents not later than seven (7) calendar days before the deadline for the submission and receipt of bids.”

          The implementation calendar is therefore correspondingly amended.  (See attached)

          All terms, conditions and instructions to bidders inconsistent with the requirement of this Bid Bulletin are hereby modified.  

          Please be guided accordingly. 

          Let this Bid Bulletin be published in a newspaper of general circulation in the Philippines.
