Invitation to Bid

Service Vehicles for use of the Offices of the Regional Election Directors
( BAC - (M) - Ref. # 2009 - 013)

Promulgation: 29 June 2009

1. The Commission on Elections (COMELEC), through the balance of the FY 2008 ARMM Automation Appropriation intends to apply the sum of Sixteen Million Pesos (P16,000,000.00) being the Approved Budget for the Contract (ABC) to payments under the contract for the Supply and Delivery of Sixteen (16) Units of 4x2 Pick-up.

Bids received in excess of the ABC shall be automatically rejected at Bid Opening.

2. The COMELEC now invites Bids from eligible Bidders for the Supply and Delivery of Sixteen (16) units of 4x2 Pick-up. Delivery of the GOODS is required fifteen (15) days upon receipt of funded Purchase Order. The description of an eligible Bidder is contained in Section II of the Bidding Documents, ITB.

3. Bidding will be conducted through open competitive bidding procedures using non-discretionary pass/fail criteria as specified in the Implementing Rules and Regulations Part A (IRR-A) of Republic Act 9184 (R.A. 9184), otherwise known as the "Government Procurement Reform Act." and is restricted to Filipino citizens/sole proprietorships, organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws or regulations of which grant similar rights or privileges to Filipino citizens, pursuant to Republic Act 5183 (R.A. 5183) and subject to Commonwealth Act 138 (C.A. 138). Only Bids from Bidders who pass the eligibility check will be opened. The process for the eligibility check is described in Section II of the Bidding Documents, ITB. The bidder with the Lowest Calculated Bid (LCB) shall advance to the post-qualification stage in order to finally determine responsiveness of the bid to technical and financial requirements of the project. The contract shall then be awarded to the Lowest Calculated and Responsive Bidder (LCRB) who was determined as such during the post-qualification procedure.

4. Interested Bidders may obtain further information from COMELEC Bids and Awards Committee (BAC) Secretariat and inspect the Bidding Documents at the address given below starting June 30, 2009 to July 21, 2009 at 800H to 1700H from Monday to Friday.

5. A complete set of Bidding Documents may be purchased by interested Bidders from the address below and upon payment of a non-refundable fee in the amount of Thirteen Thousand Pesos (P13,000.00) to the Comelec Cash Division. The method of payment will be on cash basis. The prospective Bidder or his authorized representative shall receive the Bidding Documents personally.

6. The COMELEC will hold a Pre-Bid Conference open to all interested parties on July 7, 2009 at 1400H at COMELEC Session Hall, 8th Floor Palacio del Gobernador, Intramuros, Manila.

7. Bids and eligibility requirements must be submitted on scheduled Bid Opening on or before July 21 , 2009 at 1400H at COMELEC Session Hall, 8th Floor Palacio del Gobernador, Intramuros, Manila. All Bids must be accompanied by a Bid Security (1% of the ABC) in the form of cash or manager's/cashier's check payable to the Commission on Elections. Bids will be opened in the presence of the Bidders' representatives who choose to attend. Late Bids shall not be accepted.

8. COMELEC assumes no responsibility whatsoever to compensate or indemnify bidders for any expenses incurred in the preparation of the bid.

9. COMELEC reserves the right to accept or reject any Bid, to annul the bidding process, and to reject all Bids at anytime prior to contract award, without thereby incurring any liability to the affected Bidder or Bidders.
