WHEREAS, the Commission on Elections on March 6, 2008 promulgated Resolution No. 8427 setting the rules and regulations for the resumption of continuing registration in the Autonomous Region in Muslim Mindanao, and Resolution No. 8432 dated 11 March 2008 setting guidelines on the deletion of the names of verified double/multiple registrants in the list of voters found in the Autonomous Region in Muslim Mindanao (ARMM);
WHEREAS, Resolution Nos. 8427 and 8432 were promulgated to achieve the policy of the Commission to establish a clean, complete, permanent and updated list of voters;
WHEREAS, the Automated Fingerprint System (AFIS) reveals that there are multiple/double registered voters in the ARMM;
WHEREAS, a clean list of voters is indispensable to ensure a credible and orderly elections in the ARMM;
NOW, THEREFORE, the Commission, by virtue of the powers vested in it by the Constitution of the Republic of the Philippines, the Omnibus Election Code, Republic Act No. 8189 and other related election laws, RESOLVED to promulgate, as it hereby promulgates, the following supplemental guidelines to be observed by the Election Officers/Acting Election Officers and Election Registration Boards in the Autonomous Region in Muslim Mindanao (ARMM), to wit:
- Election Officers/Acting Election Officers shall:
- Review all applications for registration and verify the date of birth of each and every applicant, and the period of residence in the Philippines and in the locality, if such data are available, then mark it accordingly, i.e., lack of age or residence requirement, to serve as guide during the Election Registration Board (ERB) hearing;
- o over and review the digital photographs of all applicants appearing in the Data Capture Machine (DCM) in order to verify whether there are applicants who appear to be minors;
- f there are applicants who appear on the Data Capture System to be minors, they shall be summoned to appear before the Election Registration Board (ERB) hearing on April 27, 2008 and submit documents/evidence to support their age qualifications;
- Post in the bulletin boards of the Municipal/City Hall or at the Office of the Election Officer the list of voters with double or multiple registrations as identified through the Automated Fingerprint System (AFIS) whose application were not acted upon during the Election Registration Board hearing on March 28, 2008, pursuant to Resolution No. 8432, due to the late arrival of the said list from the Information and Technology Department (ITD).
- Furnish the Dominant Majority Party, Dominant Minority Party and the Citizens' Arm in the locality with a copy of the said list.
- ubmit to the Election Registration Board (ERB) the names of voters with double registration, for consideration during the April 27, 2008 hearing.
- During the April 27, 2008 hearing, the Election Registration Board (ERB) in addition to Sec. 19 of Resolution No. 8427, shall:
- Disapprove all applications of those whose date of birth is later than August 11, 1990, or those whose period of residence in the locality is less than six (6) months as of August 11, 2008.
- Disapprove the application for registration of minors who despite being summoned, failed to appear before the Board to dispute and submit evidence as proof that they possess the age qualification to register.
- Unless properly objected to, immediately delete from the Computerized Voter's List (CVL), the names of voters with double registration in accordance with Resolution No. 8432. In case there are objections, the Election Registration Board (ERB) shall rule thereon, either to delete or retain the name in the CVL.
This resolution shall take effect immediately upon its promulgation.
Let the Election and Barangay Affairs Department (EBAD), Regional Election Director (RED) of the Autonomous Region in Muslim Mindanao, Provincial Election Supervisors (PESs) and Election Officers (EOs) of Lanao del Sur, Maguindanao, Shariff Kabunsuan, Basilan, Sulu and Taw-Tawi, implement this Resolution.
