MINUTE RESOLUTION No. 09-0307

IN THE MATTER OF THE PROPOSED MECHANISMS ON DETAINEES'
REGISTRATION AND VOTING IN CONNECTION WITH THE 2010 ELECTIONS

This pertains to the May 26, 2009 Memorandum of Commissioner Rene V. Sarmiento, Chairman, Committee on Detainee Registration and Voting, on the proposed mechanisms on detainees' registration and voting in connection with the 2010 Elections.

The Memorandum of Commissioner Sarmiento reads:

       "After two consultation meetings with Atty. Jose M. Tolentino, Jr., Executive Director and Atty. Bartolome J. Sinocruz, Jr., Deputy Executive Director for Operations and due consideration to their valuable comments and recommendations on the proposed mechanisms of detainees' registration and voting, the Committee on Detainee Registration and Voting decided to adopt the following mechanisms:

DETAINEE REGISTRATION:

Modes Required Number of Detainees Court Order Detainees who can Register
1. On site through satellite registration
At least 200 detainees who are qualified to register as voter and/or transfer registration records due to change of residence before detention
No court order needed. It follows the idea of satellite registration
Qualified detainees who are residents of the city or municipality where they are incarcerated

For cities where there are several districts; only the detainees who are residents of the said district where the detention center is located.
2. Off-site registration through escorted registration via express lane where detainees will be given priority.
Less than 200 detainees
Detainees need to obtain court order to be allowed to go out and register before the election officer of the city or municipality of residence.
Qualified detainees who are residents of the city or municipality where they are incarcerated.

DETAINEE VOTING:

Modes Required Number of Detainees Court Order Detainees who can Vote
1. Off-site Escorted Voting in different precincts of the city or municipality
None
Detainees need to obtain a court order in order to be allowed to vote outside jail premises.
Detainees who are registered voters in the city or municipality of incarceration.

The Cornmission RESOLVED, as it hereby RESOLVES, to approve and adopt the following mechanisms for the registration and voting of detainees in connection with the 2010 Elections as proposed by the Committee on Detainee Registration and Voting, to wit:
