RESOLUTION No. 8682

CALENDAR OF ACTIVITIES AND PERIODS OF PROHIBITED ACTS
IN CONNECTION WITH THE NOVEMBER 25, 2009 PLEBISCITE
TO RATIFY THE CONVERSION OF THE MUNICIPALITY OF DASMARIÑAS,
PROVINCE OF CAVITE INTO A COMPONENT CITY
PURSUANT TO REPUBLIC ACT NO. 9723 DATED OCTOBER 15, 2009.

Pursuant to the powers vested in it by the Constitution, the Omnibus Election Code, R. A. No. 7166, 6646 and Republic Act No. 9723 and other election laws, the Commission on Elections has RESOLVED to adopt, as it hereby RESOLVES to adopt, the following CALENDAR OF ACTIVITIES AND PERIOD OF PROHIBITED ACTS for the November 25, 2009 Plebiscite to ratify the Conversion of the Municipality of Dasmariñas, Province of Cavite into a Component City as follows:

NOVEMBER 3, 2009 (TUE) to NOVEMBER 28, 2009 (SAT) PLEBISCITE PERIOD 1. Bearing, carrying or transporting firearms or other deadly weapons in public places, including any building, street, park, private vehicle or public conveyance, even if licensed to possess or carry the same, unless authorized in writing by the Commission. (Sec. 261 (p) (q) (s) OEC as amended by 7166;

2. Suspension of elective local officials. (Sec. 261 (x) OEC);

3. Transfer of officers and employees in the Civil Service. (Sec. 261 (h) OEC);

4. Organization or maintenance of reaction forces, strike forces or other similar forces. (Sec 261 (u) OEC).
NOVEMBER 3, 2009 (TUE) TO NOVEMBER 16, 2009 (MON)   1. Appointment or hiring of new employees. Sec. 261 (g) OEC);

2. Creation or filling up of new positions. (Sec. 261 (g) OEC);

3. Promotions or giving of salary increases, remuneration or privilege. (Sec. 261 (g) OEC);

4. Construction of public works, delivery of materials for public works and issuance of treasury warrants or similar devices for a future undertaking chargeable against public funds. (Sec. 261 (w) OEC);

5. Releases, disbursements or expenditures of public works and social services and development. (Sec. 261 (v) OEC);

6. Appointment or use of special policemen, special/confidential agents or the like. (Sec 261 (m) OEC);

7. Use of armored land, water or aircraft. (Sec. 261 (r) OEC);

8. Wearing of uniforms and bearing of arms. (Sec. 261 (s) OEC).
NOVEMBER 3 (TUE) to NOVEMBER 22, 2009 (SUN) CAMPAIGN PERIOD  
NOVEMBER 20, 2009 (FRI) Submission to Comelec of complete list of all special policemen, special/confidential agents or persons performing similar functions in the employ of barangay chairman, municipal mayor or any appointing authority.

Last day for appointment of members of Plebiscite Committees
 
NOVEMBER 19, 2009 (THU) TO NOVEMBER 23, 2009 (MON) Posting of the Certified List of Voters  
NOVEMBER 24, 2009 (TUE)   1. Liquor Ban (starting 12 Midnight) - Selling, furnishing, offering, buying, serving, or taking intoxicating liquor, etc. (Sec 261 (dd), (1), OEC).

2. Campaigning (Sec. 3, OEC)
NOVEMBER 25, 2009 (WED) PLEBISCITE DAY 1. Cockfighting, and other forms of gambling, holding fairs, boxing and/or any other similar sports. (Sec 261 (dd) OEC)

2. Giving, accepting free transportation, food, drinks, and things of value (Sec. 89, OEC).

3. Selling, furnishing, offering, buying, serving, or taking intoxicating liquor, etc (Sec. 261 (dd), (1), OEC).

4. Opening of booths or stalls for the sale of merchandise, refreshment, etc. within 30 meters radius from polling place (Sec. 261 (dd) (2) OEC).

5. Campaigning (Sec. 3, OEC)

6. Soliciting votes or undertaking any propaganda for or against any candidate or any political party within the polling place or within thirty (30) meters thereof (Sec. 261 (cc), and (3) OEC);

7. Voting more than once or in substitution of another (Sec. 261 (z) (2) and (3), OEC).
NOVEMBER 28, 2009 (SAT) LAST DAY OF PLEBISCITE PERIOD  

Let this Resolution be published in two (2) national newspapers of general circulation, and in one (1) local newspaper with general circulation in the Municipality of Dasmariñas, Cavite. The Deputy Executive Director for Operations shall furnish the Regional Election Director of Region IV, the Provincial Election Supervisor of Cavite, the Election Officer of Dasmariñas, the Secretary of the Department of the Interior and Local Government, the Secretary of the Department of Justice, the Secretary of the Department of Education, the Provincial Governor of Cavite, the Municipal Mayor of Dasmariñas, and the DepEd Supervisor with a copy of this Resolution.

The Regional Election Director of Region IV, assisted by the Provincial Election Supervisor of Cavite and the Election Officer of Dasmariñas, Cavite shall give this Resolution the widest dissemination.

This Resolution shall take effect after its publication in two (2) national newspapers of general circulation.
