This pertains to the designation of Commissioner Resurreccion Z. Borra as Acting Chairman of the Commission in view of the irrevocable resignation of Chairman Benjamin S. Abalos, Sr. effective 01 October 2007 which was noted by the Commission in its Resolution No. 8306 promulgated 02 October 2007.
To avoid any hiatus in office, the Commission is guided by Resolution No. 7808 promulgated on 16 January 2007 entitled: "IN THE MATTER OF AMENDING RULE 3 SECTIONS 4, 6 AND 8; RULE 18 SECTIONS 1 AND 5; AND RULE 38 SECTION 8 WITH ADDITIONAL SECTIONS OF THE 1993 COMELEC RULES OF PROCEDURE AND INSERTING A NEW RULE ON PRECEDENCE AND PROTOCOL", the pertinent portion of which reads:
Sec. 2. When Rule on Precedence is Applicable. - The rule on precedence shall be applied in the following instances:
(a) In case of permanent vacancy in the office of the Chairman or permanent inability to perform the powers, functions and duties of his office, the Commissioner who is first in precedence shall perform his powers, functions and duties until another Chairman is appointed and has qualified or such disability is removed. In case of his absence, the Chairman may designate the most Senior Commissioner to act in his stead and behalf; however, in the event of the Chairman's temporary absence, disqualification or inhibition to preside over a particular case, the Commissioner who is first in precedence shall take over.

Following the foregoing rule, the first in precedence according to the order of the transmittal of appointments of the members of the Commission as officially transmitted from Malaca ñang, is Commissioner Resurreccion Z. Borra.
In view of the foregoing, the Commission after due deliberation RESOLVED, as it hereby RESOLVES, to designated Commissioner Resurreccion Z. Borra as Acting Chairman and shall perform the powers, functions and duties of the Chairman until the appointment of a regular Chairman.
Let the Executive Director this resolution to all departments/offices concerned.
